Terms of Use

These terms govern your use of Tida, a task app for iPhone, iPad and Mac. Please read them. By downloading or using Tida you agree to them. If you do not agree, do not use the app.

Who these terms are with

Tida is made and published by Daoud Mansour. In these terms, “we” and “us” mean Daoud Mansour, and “you” means the person using the app.

There is no Tida account. You do not register with us, and we do not hold a profile for you.

Your licence to use Tida

We grant you a personal, non-exclusive, non-transferable licence to use Tida on Apple devices that you own or control, as permitted by the App Store terms you already agreed to with Apple. The licence lasts as long as you comply with these terms.

You may not sell, rent, sublicense or redistribute the app, attempt to extract its source code, or remove any notices from it. The app and its design remain ours.

What Tida is, and what it is not

Tida keeps tasks. It is a tool for organising your own work, and nothing in it is advice of any kind. You are responsible for what you put in it and for acting on it.

There is no Tida server. We do not host your tasks, we do not receive them, and we have no way to read them. On the free plan your data stays on your device. With Premium it syncs through your own iCloud, held by Apple under your Apple ID. Our privacy policy sets out exactly what that means.

Your content and your backups

Your tasks are yours. We claim no rights over anything you write in Tida.

Because we hold nothing, we cannot recover anything for you. If you delete a task, delete the app, or lose a device, we have no copy. Tida can export everything you have to a file at any time, and Premium can save backups in your own iCloud; keeping a copy you can return to is your responsibility, not ours.

Premium, purchases and auto-renewal

Tida Premium is an auto-renewing monthly subscription sold through the App Store, with a free trial for new subscribers. Current pricing is shown in the app before you buy, and in your local currency.

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
• Your Apple ID is charged for renewal within 24 hours of the end of the current period.
• You can manage or cancel the subscription in your Apple ID settings at any time. Cancelling stops the next renewal; it does not refund the period you are in.
• If you cancel during a free trial, any unused part of the trial is forfeited when you subscribe, where Apple’s rules require that.

We do not take your payment and we cannot issue refunds. Apple handles every transaction. Refund requests go to Apple, through the App Store.

If your subscription lapses, nothing of yours is deleted. Buckets beyond the free allowance become read-only, and everything in them stays readable and exportable, and comes back when Premium is on again.

Calendar access

If you turn on calendar sync, iOS or macOS asks your permission first and you choose which calendars Tida may read. Access is read-only: Tida never creates, edits or deletes anything in your calendar, and calendar information is never sent anywhere. You can revoke that permission at any time in Settings on iPhone and iPad, or System Settings on a Mac.

Acceptable use

Use Tida lawfully. Do not use it to break the law, and do not attempt to interfere with the app’s operation or with Apple’s services through it.

Apple’s role in this agreement

Tida is distributed through the App Store. Apple’s Licensed Application End User License Agreement sets terms that apply to every application sold there, and the points below restate the parts of it that concern you directly.

• This agreement is with us, not Apple. These terms are between you and Daoud Mansour. Apple Inc. is not a party to them and is not responsible for Tida or its contents.
• Support. We alone are responsible for maintaining and supporting Tida. Apple has no obligation to provide any maintenance or support services whatsoever.
• Warranty. If Tida fails to conform to any warranty we give, you may notify Apple, and Apple will refund the purchase price of the application to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to Tida. Any other claims, losses, liabilities, damages, costs or expenses arising from a failure to conform to a warranty are our responsibility.
• Claims. We, not Apple, are responsible for addressing any claim relating to Tida, including product liability claims, any claim that Tida fails to meet a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law.
• Intellectual property. If a third party claims that Tida infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple has the right to enforce them against you as a third-party beneficiary.

Warranty and limitation of liability

Tida is provided as it is. To the maximum extent permitted by law we make no warranty that the app will be uninterrupted, error-free, or that it will meet your requirements, and we disclaim the implied warranties of merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for loss of data or profits, arising out of your use of Tida. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim — which, because Apple takes your payment, may be nothing.

Nothing here limits any right you have under the consumer law of your own country that cannot be limited by agreement.

Termination

You may stop using Tida at any time by deleting it. We may end this licence if you materially breach these terms. On termination the licence ends; your own data on your device and in your iCloud is unaffected and remains yours to export or delete.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in California, and you consent to their jurisdiction.

Revisions to these terms

We may update these terms as the app changes. The date at the top says when they were last revised, and continuing to use Tida after a revision means you accept it. Material changes will be noted in the app’s release notes.
